Welcome to Matzy. These Terms of Service govern your use of the Matzy website and your purchase of products from Matzy.

1. About Matzy

Matzy is an Australian business providing thoughtfully designed resources and products for speech pathologists, occupational therapists, educators, parents and children. 

Our products are designed to support engagement, communication, learning and play. They are intended to be used as therapeutic, educational or play resources and are not a substitute for professional medical, developmental or therapeutic advice.

However, colours may appear slightly different depending on your device or screen settings, and monitor variations may occur between products. 

Matzy reserves the right to update product information, specifications, availability and pricing at any time without notice. 

4. Pricing

All prices displayed on the Matzy website are in Australian dollars (AUD) and includes GST where applicable. 

Prices may change from time to time. The price applicable to your order is the price displayed at the time your order is placed. 

Any applicable shipping charges will be displayed during the checkout process. 

5. Orders

When you place an order through our website, you are making an offer to purchase the selected products. 

Once your order has been received, you will receive an order confirmation by email. This confirmation does not necessarily mean that your order has been accepted if there is an issue with product availability, pricing or payment. 

Matzy reserves the right to cancel or decline an order where: 

• A product is unavailable
• There has been an obvious pricing or product description error
• Payment has not been successfully processed 
• We reasonably suspect fraudulent or unauthorised activity 
• We are unable to fulfill the order for another legitimate reason. 

If we cancel an order after payment has been received, we will provide a full refund of the amount paid for the cancelled order. 

6. Payment

Payment must be successfully processed before an order can be fulfilled. 

We use third-party payment providers to process payments. Matzy does not generally have access to or store your full payment card details. 

You agree to provide accurate and complete billing and contact information when placing an order. 

7. Shipping and Delivery 

Orders are shipped in accordance with our Shipping Policy. 

Delivery timeframes are estimates only and may be affected by circumstances outside of our control, including postal delays, weather events, transport disruptions or other unforeseen circumstances.

Matzy is not responsible for delays caused by third-party delivery services.

Please ensure that your delivery address is correct before completing your order. Matzy is not responsible for orders delivered to an incorrect address provided by the customer.

8. Returns, Refunds and Exchanges 

Our returns and refunds are handled in accordance with our Return and Refund Policy.

Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law (ACL).

If a product is faulty, defective, not fit for purpose or does not match its description, you may have rights to a repair, replacement or refund under the Australian Consumer Law.

Our products and services come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms is intended to exclude, restrict or modify your rights under the Australian Consumer Law.

Where the Australian Consumer Law provides you with a remedy, those rights apply regardless of any other terms contained in these Terms of Service.

Matzy products are designed to support therapy, education, communication, engagement and play.

Some products may be designed for use with children and should be used appropriately and with suitable adult supervision where required.

Adults, including parents, carers, educators, and therapists, are responsible for determining whether a Matzy product is appropriate for a particular child and for supervising its use where appropriate,

Matzy products should be used only for their intended purpose. 

11. Intellectual Property

All content on the Matzy website, including but not limited to:

• The Matzy name and branding 
• Logos
• Product names
• Product photographs
• Illustrations
• Written content
• Graphics
• Designs 
• Website content
• Original resources and materials 

is owned by or licensed to Matzy and is protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, sell or commercially use Matzy content without our prior written permission.

12. User Reviews and Feedback

If you provide Matzy with feedback, comments, reviews, photographs or other content, you agree that you have the right to provide that content.

By submitting content to Matzy for publication, you grant us permission to use, reproduce and display that content for legitimate business and marketing purposes, unless otherwise agreed with you.

We reserve the right to remove content that is unlawful, offensive, misleading or inappropriate.
